Terms of Use
The short version
- Dreamoon is for relaxation and sleep. It isn’t medical advice or treatment.
- Subscriptions renew automatically through Apple until you cancel, at least 24 hours before the end of the period.
- The content is for your personal listening. Please don’t copy or redistribute it.
1. About these terms
These terms are an agreement between you and the developer of Dreamoon, an independent developer based in the United States (“we”, “us”). By downloading or using the app you agree to them. If you don’t agree, please don’t use Dreamoon. Our Privacy Policy explains how we handle your data.
2. Who can use Dreamoon
You must be at least 13 years old, or the minimum age required in your country, to use Dreamoon. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
3. What Dreamoon is, and isn’t
- Dreamoon offers guided meditations and sleep stories for relaxation. It is not a medical device and not a substitute for professional diagnosis or treatment. If you have a sleep disorder, persistent insomnia, or a mental or physical health condition, talk to a qualified professional.
- Don’t listen while driving, operating machinery, or doing anything that needs your full attention. The content is designed to make you drowsy.
- Our meditations and stories are created with the help of AI tools, including AI-generated narration voices, and are reviewed before we publish them. Any resemblance to real people or events is unintended.
4. Your account
You can use Dreamoon without signing in, or sign in with Apple to keep your subscription and favorites across devices. You are responsible for the activity on your account. You can delete your account at any time in the app under Settings → Account → Delete account.
5. Subscriptions and free trials
Some content requires a Dreamoon Pro subscription. We offer monthly and yearly plans. The current price, billing period and any free trial are shown in the app before you subscribe and may vary by country.
- Payment is charged to your Apple ID account when you confirm the purchase, or at the end of the free trial if one is offered.
- Your subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
- You can manage or cancel your subscription in your iPhone’s Settings → [your name] → Subscriptions. Deleting the app or your Dreamoon account does not cancel it.
- If you cancel, you keep access until the end of the period you’ve already paid for. Any unused part of a free trial ends when you buy a subscription.
- Payments and refunds are handled by Apple under the App Store terms. You can request a refund at reportaproblem.apple.com. Nothing in these terms limits refund rights you have under the law of your country.
- If we change the price of a subscription, Apple will notify you in advance and, where required, ask for your consent before you are charged the new price.
6. Your licence to use the content
We give you a personal, non-exclusive, non-transferable and revocable licence to use the app and listen to its content on Apple devices you own or control, for your own non-commercial use, as permitted by the App Store’s Usage Rules. You may not copy, record, resell, publicly perform, broadcast or redistribute the content, extract it from the app, or use it to train AI models. All rights not expressly granted are reserved by us.
7. Acceptable use
Don’t misuse Dreamoon: don’t try to break, reverse engineer or overload the app or our servers, get around subscription checks, or use the app in a way that breaks the law.
8. Changes and availability
We may add, change or remove content and features, and we may suspend or end the service. If we end the service while you have an active subscription, we’ll tell you in advance. We may suspend or close accounts that break these terms.
9. Disclaimers and liability
Dreamoon is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted or error-free, or that it will improve your sleep. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid for Dreamoon in the 12 months before the claim. None of this limits liability that can’t be limited by law, or your statutory rights as a consumer.
10. Apple App Store terms
If you downloaded Dreamoon from the Apple App Store, you and we also agree that:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for Dreamoon and its content.
- Your licence is limited to using Dreamoon on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We are solely responsible for providing maintenance and support. Apple has no obligation to provide any maintenance or support for Dreamoon.
- We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Dreamoon fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Dreamoon.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Dreamoon or your possession and use of it, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Dreamoon or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using Dreamoon, such as your mobile data or wireless service agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
Questions, complaints or claims about Dreamoon go to us at support@dreamoon.app.
11. Governing law
These terms are governed by the laws of the United States, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.
12. Changes to these terms
We may update these terms from time to time. We’ll update the date at the top, and for significant changes we’ll let you know in the app before they take effect. If you keep using Dreamoon after the changes take effect, you accept the updated terms.
